Notice of Change of Ownership

In 2021, 6 of the 7 original founders of QONQR sold their ownership interest in the company QONQR, LLC to the remaining founder Scott Davis, CEO. In 2022, as the sole owner of QONQR, LLC, Scott Davis excersized the option to merge QONQR, LLC with his other software business Scott Davis Industries, LLC. The only purpose of the merger was to simplify accounting and tax preperation and reduce costs. The day-to-day management and the development of the game did not change as the result of the merger. All rights, responsibilities and assertions defined below transfered to Scott Davis Industries, LLC

 

This Privacy Policy describes the privacy policies and practices of Scott Davis Industries, LLC, (aka "QONQR") regarding its location-based massively multi-player online game application for mobile devices, "QONQR" (aka "QONQR : World In Play") and all associated services provided at or through the QONQR.com website (collectively, the "Services").

Most of our Users (as defined below) will use the Services as intended in a harmless way for friends and strangers to play together. But, be aware, information about your general location may be inferred through your game actions and may be subject to misuse and monitoring by other Users. Please take care with how you use the Services and with how you manage your information and communications through the Services.

Please be aware that any profile, Personal Information or Location Information (each as defined below) that you voluntarily disclose on any public forum becomes publicly available and can be read, collected, and used by others and could be used to send you unsolicited messages. Company is not responsible for any profile, Personal Information or Location Information that you choose to disclose publicly using the Services.

This Privacy Policy is incorporated into and is subject to the Terms of Service. Your use of the Services and any Personal Information and Location Information you provide in using the Services is subject to the terms of this Privacy Policy and the Terms of Use.

What Information Does QONQR Collect and How Does QONQR Use That Information?

Company optionally collects personal identification information from users of the Service. A person who uses the Services (a "User") must create an account, which requires the user to choose a codename, or accepted an assigned name, and password, and allows the User to optionally provide his or her email address (collectively, "Personal Information"). Company or its contractors retain Personal Information on their servers indefinitely. Player codenames and email addresses are stored unencrypted on a secure database. Player passwords are never stored in a database or log. An encrypted hash is generated and stored in place of the password. Never share your password with anyone, not even a QONQR employee. A QONQR employee does not need your password to access your account to assist you with support issues. Use a unique password for QONQR. Do not use a password for QONQR that you have used with another site. You may reset your password if you forget it, using your registered email address, if you provided one. Your password should only be entered into the smartphone application QONQR, which is distributed by Scott Davis Industries, LLC or though the web portal at https://portal.qonqr.com. All other applications or web sites requesting your QONQR password are fake and should be reported to support@qonqr.com. A user's password that is compromised through sharing with another site or user, stolen through the use of a compromized device or local network, or otherwise obtained through guessing or other hacking attack is not the responsibility of the Company. QONQR excersizes the rights to respond to a player's loss or compromise of their password as the copmany sees fit.

In the event a player has been awarded a physical prize or gift, the player may save a shipping address with their player account. This address is encrypted and saved in our secure database. Users concerned with security of the encrypted storage, may email their address to support@QONQR.com (please note, internet email is not encrypted in transit nor encrypted in storage on most mail systems). Users should delete thier mailing address after receiving any shipped items.

Users may upload a profile picture to use with their account. We discourage using your personal photo or the photo of another person as your profile picture. Better options would be to use a photo of your pet, a city landmark, or other image which you have the rights to use. Users may not upload a photo or image to which you do not have the right to use.

Company also collects information about the User's location by obtaining coordinates from GPS and cell tower triangulation or any other means provided by the mobile device ("Location Information"). Company or its contractors retain Location Information on their servers indefinitely. Location Information for each User is linked to the codename of that User. Location Information is only updated with the User's current location when a User opens the QONQR application on his or her mobile device. When the User terminates the QONQR application, Company stops collecting and updating Location Information. If a User desires to stop Company or QONQR from collecting and updating new Location Information, such User simply needs to close his or her QONQR application on his or her mobile device. Some Android devices do not always properly suspend execution of an application, and it may be necessary for a user to manually stop/kill the QONQR application.

Some actions a player may make in the game will alert other users to their proximity to a city, or make them aware of when you are using the application. For example, user who attack or defend a city will thereby disclose they are near that city, within 10-30 miles. Users who post messages in a chat room or send a private message to another player, will expose the time of day, they were playing the game, and posted the message.

Company does not use Personal Information or Location Information to send commercial or marketing SMS text messages or email messages to Users without their express consent or unless they have opted-in to be part of a specific program or feature. If the player optionally provides an email address as part of their account profile information, QONQR reserves the right to send player email messages regarding their account, important game updates or important company news, not to exceed more than 2 informational messages a year, unless an emergency exists.

When Users access the QONQR website, Company automatically records on its server logs certain information from that User's computer, including but not limited to web requests, Internet Protocol address (the unique set of numbers used to identify User's computers), browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the number of messages related to the User's profile, the amount of time spent on particular web pages, and the dates and times of requests.

If a visitor requests information by sending Company an email, Company may save the visitor's e-mail address and any other information that the visitor provides. This information may be used by Company to provide services or products the visitor requests and to contact the visitor in the future by mail, by e-mail, or by phone to convey information about Company's services. Such information also allows Company to respond to visitors' inquiries concerning career opportunities at Company.

Company may aggregate the information it collects by removing any data that can personally identify any specific User to create "Aggregate Information." Such anonymized Aggregate Information is not Personal Information or Location Information. Company may use Aggregate Information to analyze how Users use the Services to determine ways in which Company can improve the Services and to consider offering new services to Users.

Company may use or disclose Personal Information and Location Information to comply with applicable laws; to protect the rights and property of Company or others; to protect a person's safety; to prevent abuse; as evidence in legal proceedings; to cooperate with properly authorized law enforcement investigations; and in response to subpoenas from third parties. Company will use good faith efforts to promptly notify a User of any subpoena that seeks any of the User's Personal Information or Location Information to enable the User to seek to quash the subpoena. Finally, Company may disclose or sell Personal and Location Information as an asset in conjunction with the sale of Company to a third party or in conjunction with the sale of a portion of Company's assets.

GDPR and ePR Cookie Compliance

Company does not use any browser cookies for the purposes of tracking, advertising, marketing, data sharing, analytics or performance monitoring. Company uses only necessary temporary cookies verify user authentication, and to temporarily change the language (English, Spanich, German, etc) displayed on the website if the users select an alternate language than is stored in their account preferences.

Obtaining User Consent

To use the Services, the User must consent to: (a) the collection of his or her Location Information; (b) the sharing of his or her actions that impact a zone (city) in the game, other game activity that is publicly tracked via leaderboards, messages and chats through the Services with other Users; and (c) pay carrier data, messaging, and other fees resulting from use of the Services. Users will be prompted for this consent upon activating an account

Company may share Personal and Location Information with Company's Agents (aka Cloud Hosting Provider). Company has entered into or will enter into written agreements with Company's Agents to whom it discloses Personal Information and Location Information that requires them to adhere to pertinent provisions of this Privacy Policy and the Safe Harbor Principles issued by the U.S. Department of Commerce, which are available at http://www.export.gov/safeharbor/SH_Privacy.asp. Company also prohibits Company's Agents from using any information disclosed to them by Company for purposes other than implementing Company's instructions.

Selecting a Codename

Users wishing to maintain anonymity while playing QONQR should avoid choosing a codename that matches a username they have used in another game or online services. Users should avoid using the same name used with social media or other online networks, if they wish to avoid other users from making this connection. Users should also avoid posting their game activity or screen shots online, via Twitter®, Instagram®, Facebook® or other online social platforms. Users should not select a codename that includes all or part of their real name, nickname or other name that would be identifiable.

How to Correct, Update, Delete Account Information

A User may change or remove their email address at any time by updating their profile on the web portal at https://portal.qonqr.com. A User's email address is never associated with a player's activity in the game, and removing an email address severs the connection between the email and a User's game activity for the entire duration that User has played the game.

A player may also change their codename for a small fee using the web portal at https://portal.qonqr.com under the account profile. This can obscure a User's activity.

All messages sent in the game are currently available for up to 60 days. This duration may change in the future, without notice or update to this privacy policy. These messages may allow anyone to whom you have sent a message in the past 60 days to identify your new codename, as the "reply" option will allow them to respond to your message with your new codename. Likewise, if you still have "nanobots" (a game component that results from your activity in the game) your new codename will be reflected on the leaderbords.

How to Completely Remove, Hide, and Cleanse my Identity in QONQR when I Quit the Game

  1. Use the Web Portal (https://portal.qonqr.com) to switch factions. This will destroy all your "nanobots" (a game component that results from your activity in the game), leaving no trace of your prior activity in the game
  2. Delete all your bases in the game using the mobile client
  3. Delete you email address and any shipping address you may have entered under your Account settings in the web portal (https://portal.qonqr.com).
  4. Delete the application from your smart phone
  5. Change your codename under your Account settings in the web portal (https://portal.qonqr.com). You may choose any codename you wish, we recommend using "Deleted201601011200" with the numbers representing year month day hour minute to help ensure the name is unique.

You may email support@QONQR.com to rename your account on your behalf, however we will require that you do so before removing your email address, so we can verify that the owner of the account is requesting the codename change. Following these steps will give you the ability to completely purge your identity from the system, disconnecting any log data that maybe stored in the system from your personal identity. Following good codename selection (see section above) further helps in protecting your identity.

No online activity is completely anonymous.

Some aspects of your game activity cannot be removed from our database or logs, such as your purchase history. However following the steps above will disconnect he purchase from any previously identifiable information. Some users may have to wait up to 60 days to switch factions, and messages sent in the game may take up to 60 days before they are no longer visible to other users. However messages are retained in our system indefinitely, should there be a future need for a criminal investigation.

How Information Is Secured.

Company uses a variety of physical, technical, and procedural safeguards to guard against loss, misuse, and alteration of Personal Information and Location Information. For example, access to Personal Information is limited to Company and contractor personnel who need the information the Services; and Company uses and requires its contractors to use technical measures to guard against unauthorized access to Personal Information and Location Information. Company also requires Users to use usernames and passwords to access Personal Information and Location Information. Company cannot, however, guarantee the security of any Personal Information or Location Information. Despite Company's efforts to secure such information, it may be accessed, disclosed, altered, or destroyed by a breach of Company's physical, technical, and procedural safeguards. Users use the Services at their own risk. If Company learns that a User's Personal Information or Location Information has been disclosed to an unauthorized person, Company will attempt to use reasonable efforts notify the User.

Children's Information

Company recognizes the importance of protecting the privacy of children. Consistent with the Children's Online Privacy Protection Act, Company will not knowingly collect any Personal Information or Location Information from anyone under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, THEN YOU MAY NOT USE OR ACCESS THE SERVICES AT ANY TIME OR IN ANY MANNER. If Company learns that Personal Information or Location Information of persons less than 13-years-of-age has been collected through the Services without verifiable parental consent, then Company will take the appropriate steps to delete and cleanse this information from the system using the steps listed in "How to Correct, Update, Delete and Cleanse Information Obtained by QONQR" above. If you are a parent or guardian and discover that your child under the age of 13 has obtained an account against your wishes or without your consent, then you may alert Company at support@qonqr.com. You must be able to verify your identity by contacting us through the email address registered with your child's account. Log into your child's account on the web portal https://portal.qonqr.com and set the email address of your account under "Manage Account" to the address you will use to contact our support.

Abuse and Harassment

QONQR takes online abuse, harassment and cyber bulling seriously. Many resolution features have been implemented in the app to allow users to block abusive users and report messages for abuse. If you feel another player has violated the law in regard to cyber bulling or stalking, (1) Immediately block that player from sending you future messages and mute them in the chat; (2) contact the police and request they contact our support email (3) contact support@qonqr.com with information regarding the police district that will be contacting us about the claimed abuse. We will work with the authorities to provide the information necessary, as the law allows, to investigate and prosecute the reported crime. QONQR claims no responsibility for the actions of users you may encounter in the game. Please note: privacy policies of Apple Inc. and Google Inc., manufacturer of the iOS and Android operating systems, make blocking a player from our game with 100% accuracy impossible. While we may ban a User's account, Apple and Google make it possible for them to regain entry to our game through a new account. Apple and Google have intentionally removed our ability to keep a bad user out permanently.

Information Collected by Others

This Privacy Policy addresses only the policy and procedures of Company. Company is not responsible for the privacy policies of third parties, including but not limited to those whose websites may be linked to the QONQR website.

Use Outside the United States

The Services are hosted in the United States and is intended for United States Users. Users from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, should note that they are transferring personal data to the United States and in so doing effectively consent to that transfer.

Enforcement

If a User believes that his or her rights as described in this Privacy Policy have been violated by Company, the User should email suppport@qonqr.com or send a letter to QONQR, PO Box 120761, St Paul, MN 55112, Attention: Legal Department. Company will attempt to resolve User complaints as quickly as possible.

Amendments to this Privacy Policy

Company reserves the right, at its sole discretion, to change, modify, add to, or remove any portion of this Privacy Policy, in whole or in part, at any time. QONQR will announces updates via is blog at http://blog.qonqr.com and may include other social media channels. Amendments to the Policy will take effect immediately upon being posted to the QONQR website. User's continued use of the Services after Company posts an amendment constitutes User's acceptance of and consent to such amendment.

Bankruptcy, Merger or Acquisition

In the event that Company is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control so that Company can continue operations. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how Users' Personal Information and Location Information is treated, transferred, or used. Users will be notified via notice on QONQR communication channels (blogs, forums, and/or social media) of any such change in ownership or control of their Personal Information and Location Information.
